6102 Sayılı Türk Ticaret Kanununun Haksız Rekabete İlişkin Hükümleri Konusunda Bazı Görüşler

Abstract

6102 sayılı Türk Ticaret Kanunu haksız rekabete ilişkin hükümleri iki kolon üzerine oturtmaktadır. Bu kolonlardan ilki bütün katılanların menfaatine dürüst ve bozulmamış rekabetin sağlanması, ikincisi dürüst davranma kuralıdır. Bütün katılanlar ifadesi ile ekonomi, tüketici ve kamu haksız rekabetin koruma alanına dahil edilmiştir. Tüketicinin korunması konusunda Türk Hukukunda özel bir kanunun vardır. Aynı konuda Ticaret Kanununda haksız rekabete ilişkin hükümler çerçevesinde düzenlemeler getirilmesi bazı sorunlara neden olabilecektir. Çalışmada bu konuda ortaya çıkabilecek bazı sorunlara dikkat çekilmiştir.

Turkish Commercial Code No. 6102 places the provisions about unfair competition on two colons. The first one of these colons is; providing of the fair and uncorrupted competition for the interests of all participants and the second one is; the rule of acting fairly. With the expression of all participants; economy, consumer and public are included within the conservation area of unfair competition. There is a particular code in Turkish law about the protection of consumer. For the same subject, bringing arrangements in Commercial Code within the framework of provisions about unfair competition may cause some problems. In the study, attention is drawn about some problems, which may arise about this subject.
